SCHUYLKILL COUNTY CLERK FILED MOTION THIS AFTERNOON TO OVERTURN GAY MARRIAGE DECISION

wedding ringsDespite overwhelming support in favor of the recent legalization of gay marriage in Pennsylvania, a Schuylkill County clerk is seeking to intervene in the recent gay marriage lawsuit.
According to EqualityPA.org, Schuylkill County clerk Theresa Santai Gaffney filed a motion this afternoon (Friday, June 6, 2014) to intervene in the Whitewood vs. Wolf case.


“The fact is that marriage matters to all families and lesbian, gay, bisexual, and transgender families in Pennsylvania deserve the same dignity and protection as anyone else,” said Ted Martin, Executive Director, Equality PA.
He continued, saying, “It saddens me, as I am sure it saddens many Pennsylvanians, that some individuals are having such a hard time accepting that all people deserve to be treated equally regardless of our differences. We have branches of government for a reason, and the judicial branch has a legitimate right to interpret whether laws meet the constitutional standards that our nation’s founders created. We are glad that Judge John E. Jones examined the case and came to a reasonable conclusion. We also thank Gov. Corbett for recognizing that the majority of Pennsylvanian’s understand that love is love. The fact is that marriage matters to all families, and lesbian, gay, bisexual, and transgender families in Pennsylvania deserve the same dignity and protection as anyone else.”

This afternoon, Jim Smith and David Crossett, attorneys with the Smith Law Group, LLC, located in Fleetwood, Berks County, Pennsylvania, and Jeff Conrad, attorney with Clymer, Musser & Conrad, P.C., located in Lancaster County, on behalf of Theresa Santai Gaffney, Clerk of the Orphan’s Court of Schuylkill County, filed a Motion to Intervene in Whitewood v. Wolf, the case in which a single federal District Judge declared unconstitutional for all Pennsylvanians, the Commonwealth’s longstanding definition of marriage as between one man and one woman.
Theresa Santai Gaffney, Clerk of the Orphan’s Court, is seeking intervention in the case so that the ruling can be appealed to the U.S. Court of Appeals for the Third Circuit. Governor Corbett, who had been defending the law, declined to appeal the ruling. “An appeal is necessary so that the judicial process is not abandoned,” stated Ms. Gaffney. “The people of Pennsylvania deserve to hear from the Court of Appeals on this important issue because a single judge should not be able to nullify the will of the majority without an appeal.”
Marriage between one man and one woman has always been the law in Pennsylvania. “I respect the law of our Commonwealth and the will of the people reflected in the law,” said Ms. Gaffney. “I believe that the voice of those who think that our law is constitutional and best serves all citizens of the Commonwealth should be heard.”
“Due to the uncertainty of the state of the law, I will continue issuing marriage licenses to all couples,” said Ms. Gaffney. One of the reasons that she is seeking to intervene in this case is to obtain clarity about her official duties.
The Motion to Intervene asks the Court for the ability to join the lawsuit for purposes of appeal.

  1. Who is anyone to tell us we cant marry who we want? We live in america where we are suppose to be free! Just because someone isnt up for it does not mean they shouldnt be able yo do it? To each their own and if it makes them happy who the hell are you to judge them.

  2. This is so sad to hear…I thought this would be over & that my daughter would never have to fight to get married in her home state. It deeply saddens me that people still feel this way. Especially a woman that works for the Schuylkill County Courthouse. I hope she will at least treat my daughter with the the same professionalism & courtesy she shows straight people that’s if my daughter ever CHOSES to get married in Pennsylvania.

  3. the one man and one woman was a very long time ago…. every year things change, technology, kids, laws, people…. there is no stopping it… marriage is about loving one another, it shouldnt matter if it is one woman and one man or two women/two men…. a very long time ago it was never heard of BUT today it is more common than you realize and we have to change with the times… gays/lesbians are going to be together whether anyone likes it or not, so WHY NOT allow the marriage like straight people are allowed???… You dont have to like it or understand it, but everyone should be treated equally regardless of race, ethnicity, religion or ones personal preferences… this is what the problem is in the world… and it needs to change with the times…
